(d) if the instrument, under authority given by an Act, provides for an earlier date or time-on that date or at that time.
Examples for paragraph (b)
1 A subordinate law may provide that it commences on a stated future date or at a stated time on a stated future date.2 A disallowable instrument may provide that it commences on the day, or immediately after, a stated law, or a stated provision of a stated law, commences.
3 A notifiable instrument may provide that it commences on the expiry of a stated statutory instrument.
4 A notifiable instrument may provide that it commences on the date fixed by a Commonwealth Minister, by notice in the Commonwealth Gazette, under a stated Commonwealth Act.

(4) A statutory instrument that is not a registrable instrument commences-
(a) on the day it is made or, if it is required under an Act or statutory instrument to be approved (however described) by the Executive, a Minister or any other entity, the day it is approved; or
(b) if an Act or the instrument provides for a later date or time of commencement-on that date or at that time; or
(c) if an Act provides for an earlier date or time of commencement-on that date or at that time; or
(d) if the instrument, under authority given by an Act, provides for an earlier date or time-on that date or at that time.
